1. Acceptance of Terms

These Terms of Service (�Terms�) govern your access to and use of ChatEdge Telemed (the �Service�). By creating an account, booking a visit, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy.

2. Not for Emergencies

The Service does not provide emergency medical care. Do not use the Service if you believe you require urgent or emergency treatment. Call 911 or go to the nearest emergency department.

3. Eligibility & Account

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. Minors may use the Service only with a parent/guardian account and subject to applicable law.
  • You agree to provide accurate registration information and keep it current. You are responsible for safeguarding your credentials and for all activities under your account.
  • We may suspend or terminate accounts that violate these Terms or applicable law.

4. Telemedicine Consent

By using the Service, you consent to receive medical services via telehealth technologies, which may include video, audio, chat, and electronic exchange of medical information. You understand that:

  • Telemedicine has limitations compared to in-person care, including potential for incomplete clinical evaluation.
  • Technical failures may occur. If a session drops, we will attempt to reconnect or reschedule.
  • You may withdraw consent at any time, but doing so may limit your ability to receive services.

5. Privacy & Security

We take privacy and security seriously and implement administrative, technical, and physical safeguards appropriate to the Service. Please review our Privacy Policy for details on data collection, use, and sharing. You agree not to share your account or PHI on unsecured channels and to notify us of any unauthorized access.

6. Payment & Billing

  • Fees for visits or services will be presented at checkout or prior to booking. You authorize us and our payment processors to charge your selected payment method for all amounts due.
  • Third-party fees (e.g., mobile data, pharmacy charges) are your responsibility.
  • We may change fees prospectively with notice posted in the Service.

7. Scheduling, Cancellation & Refunds

  • You may cancel or reschedule within the windows described at booking. Late cancellations or no-shows may incur fees.
  • Refunds, if any, are issued according to our posted policy and applicable law.
  • We may cancel or reschedule a visit due to provider availability or technical issues.

8. Prescriptions & Pharmacy

  • Providers on the Service may prescribe medications when clinically appropriate and permitted by law. Prescriptions are at the provider�s professional discretion.
  • Certain medications (e.g., controlled substances) may be restricted or unavailable via telemedicine or in your jurisdiction.
  • You are responsible for pharmacy selection, costs, and pickup/delivery arrangements.

9. Communications & Notifications

  • By providing contact information, you consent to receive transactional communications related to your care (e.g., appointment reminders) via email/SMS. Message and data rates may apply.
  • You may manage notification preferences in your account or by following instructions in the message. Some transactional messages are required to deliver the Service.

10. Your Responsibilities

  • Provide accurate medical history and information, including current medications and allergies.
  • Use compatible devices and a stable internet connection; ensure a private, well-lit space for visits.
  • Follow provider instructions and seek in-person care or emergency services when advised.

11. Prohibited Uses

You agree not to misuse the Service. Prohibited activities include, without limitation: violating laws or regulations; impersonating others; sharing false or misleading information; attempting to access or probe systems without authorization; introducing malware; scraping; reverse engineering; or infringing third-party rights.

12. Disclaimers

Except as expressly provided, the Service is provided �AS IS� and �AS AVAILABLE.� To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.

13. Limitation of Liability

To the maximum extent permitted by law, in no event will ChatEdge Telemed, its affiliates, or providers be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Service. Our aggregate liability will not exceed the greater of (a) the amounts you paid for services in the 6 months preceding the claim or (b) USD $100.

14. Indemnification

You agree to defend, indemnify, and hold harmless ChatEdge Telemed and its affiliates, officers, employees, agents, and providers from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys� fees) arising out of your breach of these Terms or misuse of the Service.

15. Governing Law

These Terms are governed by the laws of the jurisdiction where the Service is offered and the provider is located, without regard to conflict-of-law principles. Venue and jurisdiction will lie in the courts of that jurisdiction, unless applicable law requires otherwise.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted in the Service with an updated �Last updated� date. Your continued use after changes become effective constitutes acceptance of the updated Terms.
